dog snarling through fence

Whenever you come across a playful pup, it’s easy to forget that dogs have the potential to cause serious harm. At the end of the day, however, even the friendliest Fido acts on instinct, which means they will attack if they feel threatened. While a minor dog bite may leave little more than a scratch, a major incident can result in devastating injuries. The latter probably seems unlikely, but it happens far more often than most people realize. More than 4.5 million Americans are … [Read more...]

May 18, 2022 by Michael Waks

dog biting man's hand

While some dogs are more inclined to attack than others, every animal has the propensity to cause harm. In fact, roughly 1,000 people across the United States need emergency medical care following a dog bite every single day.  Thankfully, California holds pet owners strictly liable for any damages their dogs cause. That means victims don’t have to prove negligence on the part of the owner to secure compensation.  Of course, recovering a payout can still pose a … [Read more...]

In the state of California, dog owners are almost always strictly liable for the damages their dogs cause in the event of an attack. As such, dog bite victims typically do not have to prove the owner was negligent in order to recover compensation for medical bills, lost income, and other damages. Unlike other states, California does not have a “one-bite rule.” That means dog owners can be held strictly liable for damages even if their animal had never bitten anyone or displayed vicious … [Read more...]

In California, a dog owner is responsible for any injuries caused when their dog bites a person. But what if the dog bite victim is another dog? California’s dog bite law does not apply to situations where one dog bites another dog. Despite this, when a dog bite victim is a canine, the victim’s owner can often recover damages. Can a Landlord Be Held Responsible for a Dog Bite Inflicted by a Tenant’s Dog?

October 28, 2015 by Michael Waks

Over five million people are bitten by dogs each year in the United States with young children being at a much higher risk for dog bites than other age groups. The consequences of dog bites are severe for the victim and the victim’s family. Dog bites cause severe trauma for the victim and often result in permanent disfigurement. If you or a family member has been injured due to a vicious dog attack, call the Law Office of Michael D. Waks to schedule a free consultation with an attorney to discuss your legal options for recovery. You are under no obligation because you never pay any money until and unless you receive a recovery. Who is Responsible for Damages from a Dog Bite or Attack? According to California dog bite laws, the owner of the dog is responsible for any damages caused by a dog bite or dog attack. California Civil Code Section 3342 states that the owner is strictly liable for any damages caused by the dog regardless of whether the dog has displayed any prior violent tendencies. Strict liability means that the owner is still responsible for the damages caused by a dog bite even though the dog may have never bitten anyone before this incident. Unfortunately, dog owners who are renting their residence may not have property insurance that covers dog bites and they may not have sufficient assets to pay for damages caused by dog bites. In some cases, the landlord, who typically does have insurance and may have substantial assets, can be held liable when a tenant’s dog bites someone. The courts have held that if the landlord had knowledge that a dog had vicious propensities and the landlord did not terminate the lease when possible, the landlord could be held liable if the dog attacked and bit someone on the property. Because it can be difficult to prove that the landlord had prior knowledge of the dog’s vicious propensities in addition to knowing that the dog was on the premises can be difficult, it is important to hire an experienced dog bite attorney as soon as possible following the accident. Each dog bite case is different and the circumstances surrounding the accident are unique to that case. Michael Waks performs a thorough investigation in each dog bite case to determine who is liable for your injuries to ensure that all responsible parties are held accountable for your damages. Attorney Waks is very knowledgeable and dedicated to his clients. I was involved in a car accident through no fault of my own, and Mr. Waks took care of a Nightmare involving the insurance company. Even though my case was relatively minor and not very rewarding for him financially, he still charged in headstrong and treated me with the utmost respect. Highly recommended!

Michael represented me in a personal injury case and I can’t recommend him enough. From the very first consultation he made sure that I was always aware of my options and up to speed with every aspect of my case. He answered all my questions and used his experience and expertise to help guide my decisions instead of trying to make them all for me. He not only ensured that the settlement I received was more than enough to cover all my bills and expenses but he also made sure I had piece o… Read more

Our Child Caregiver was in a serious car accident around Canoga Park in the valley and her car was totaled. Thank goodness our kids were not in the car at the time and she was not seriously injured. Since she is not originally from the United States and doesn’t have much familiarity on how to handle the situation, I helped her and hired Michael who took her case. The plaintiff claimed falsely that he had a green light when in fact he turned right on a red in front of our caregiver. Since… Read more

I would recommend Michael Waks to anyone who needs a personal injury lawyer. Mr. Waks helped me in two different cases. He was there all the time, not an assistant, he was there step by step for me and my family. He is upfront of what he can do for you. Michael Waks is the “BEST”.

Michael Waks is GREAT! I’ve been involved in two separate auto accidents. One as a passenger and one as a driver. He has been very helpful in both cases. We used his services for our first accident and then when I was involved in my own accident, I went back to him as he provided great service. I have even referred him to others. I would recommend Michael Waks!!”
